Fairhope Golf Carts/Bikes Not Following Traffic Laws?

BIKE/PEDESTRIAN COMMITTEE WORRIED

During its June meeting, city Bike and Pedestrian committee members discussed observing lack of adherence to traffic laws by bicyclists, skateboarders in the central business district, ... and low speed electric vehicles (aka golf carts) generally throughout town.

Member Katie Bolton said she was almost hit recently by a cyclist "zooming by" on the Fairhope Avenue sidewalk (at Bancroft) ... even though bikes are not permitted on sidewalks there. Skateboarders downtown are doing the same thing according to another member.  No signs regulating such activities are currently posted, member Chris Riley said.

Other members said they had observed "golf carts" not signaling turns, driving up from the pier with "drinks" in their hands, running stop signs, often driven by children, ... and even being driven on sidewalks.  Bolton said that happens frequently in front of her store on Fairhope Avenue (across from the post office) ... and on designated bike trails throughout town.

Bolton: "Pedestrians always have the right of way" (on sidewalks/trails).

No member of the committee had ever seen a golf cart being "pulled over" by police but Bolton, an avid cyclist, said her cycling groups had been.

FRUIT N' NUT TOO?

A citizen who lives in the Fruit and Nut neighborhood contacted the Times independently about the same issue. "Golf carts" sometimes driven by children speeding, running stop signs (Pecan at Satsuma) and generally not obeying the rules of the road.

POLICE CHIEF INVITED TO NEXT MEETING

Committee members resolved to ask police chief Hollinghead to attend their next meeting to discuss possible solutions, such as tighter enforcement, signs, etc.

Planning director Hunter Simmons who is a member of the committee as well observed that other towns decided to adopt stricter ordinances to better-regulate the carts (Orange Beach).

Simmons said there are currently two "golf cart stores" in town but a third is on the way. 

The committee's next meeting is July 5 at 4 PM at the library (Gidens Room). All meetings are open to the public per state open meeting law.

My concern is safety. Parents allowing their young children to drive these golf carts at a high rate of speed and recklessly. Not an adult anywhere around.

It is past time for the Fairhope PD to step up and address the golf cart issue not just down town but on all city streets. In our large subdivision there are very young children driving golf carts. I have seen the drinking golf cart drivers all over downtown especially near the pier at sunset.

I think we should ban all golf carts, bicycling skateboarding and roller blading.
We should ban drinking as well as that can lead to undesired outcomes.

Also should consider banning children from going outside if the area is not fenced in.

Focus your efforts on the speeding cars and trucks. That's the issue. Golf carts have a maximum speed of 25 mph and weigh significantly less than a vehicle. Yes, I do see kids driving their parents golf carts and that is the parents fault. I also see cars and trucks speeding every morning on Section Street directly in front of the police station. They turn off of Magnolia Avenue and speed down the hill. They're probably late for work. The easy fix is to place REAL speed hump devices downtown so when a driver hits it at a high rate of speed they know they hit it. The $300K lighted cross walk across from the police station was a waste of tax payers money. It sounded great in theory but no-one pays attention to it. The old fashioned speed hump works every time.

When a path is provided (e.g. HWY 98, CR1) bicycles must use them under state law. Cyclists are very good at asserting their rights to the road, but not so good at following the rules of the road. Every day, they create dangerous conditions for vehicular traffic. Start ticketing them.

Golf carts and bikes should be following the same laws as a motorist. If not, like under age drivers of a golf cart, then they should be cited. Start putting out some warnings and actual citations and the word will spread and hopefully help correct it. It has gotten out of control.

Ya'll do not understand how it works around here. Police work for police chief, who works for mayor/councilmen, who work for realtors and developers, who do not want traffic laws inforced because it may hurt sales!

Bingo! Realtors and developers are forcing parents to send their middle-schoolers out on golf carts, enchanting cyclists to disobey traffic control devices, and spreading Covid-19 (probably).
And where were they on December 7, 1941, September 11, 2001, and January 6, 2021?

It's not so much a theory as it the manifestation of unhappy people needing hobgoblins upon whom they can pin their unhappiness. Fortunately, they have no influence on civic life because they sit and complain rather than get up to do the work required to improve our community.

The Orange Beach ordinance for golf carts is nothing more than another cash grab for the city. The ordinance requires an inspection to operate on city streets. But the inspection parameters are exactly the same as the ones that make a cart street legal in the first place, and allows for the issuance of a vehicle tag. If it's legally tagged, it's street legal. If a vehicle, whether it is a bike or a cart, is breaking the law, then enforcement of the law is the issue that needs to be solved. There needs to be much more education for everyone in the city about what the laws are, and who has the right of way. I've asked several times over the years for the quarterly newsletter to provide a column with this sort of info from the police department. But it's never happened.

Some states and cities even require a tag for bicycles. A riders safety program has to be completed first before they will issue the tag.
