In a Sept. 21, 2009 letter to the Mayor, the Fairhope Tree Committee cited violations of the City's Tree Ordinance during planning/construction of Phase 1 of the Fly Creek PUD (aka Publix): "The tree survey was not performed until after (vice before) the Planning Commission . . . approved the site . . . in Dec. 2007 . . . (resulting in) . . . 50 ordinance protected trees . . . plus other significant trees . . . (being) removed . . . from the Parker/Greeno Rd. right of ways."
