Nichols St. Deck Lawsuit Update

Public Works Director Fidler told the Council that Judge Wilters should decide the matter within a month or so.

The city was sued by neighboring property owners (over right-of-way issues) to prevent construction of the proposed public facility -- at the bay-front end of Nichols St.

Other neighborhood residents had requested a waterfront structure be constructed there -- on city property. The Single Tax Corporation is to pay for the materials needed.

It is not private property; it is public property that the adjacent property owners are encroaching upon, enjoying and preventing the public from equal enjoyment. If the judge rules in the private owners favor, then sell it to them at fair market value and they can pay taxes on it and upkeep it at their own expense.
