Federal Appeals Court Dismisses Dyas' Suit Against City

REGARDING "TRIANGLE" PROPERTY

City Administrator Greg Mims read a statement from the Mayor about the recent dismissal by the federal appeals court in Atlanta of a lawsuit filed against the city over development of the Dyas Triangle property north of town (Village North PUD).

Among other things, the lawsuit alleged discrimination: a nearby development (Publix/ Fly Creek PUD) was given preferential treatment by the city.

Mims: "... all but one aspect ... relating to traffic issues ... have been dismissed ... ."

One small part of the lawsuit (regarding traffic control issues) was remanded to state court and is still awaiting disposition.

CITY'S APPEAL DISMISSED TOO

A simultaneous appeal by the city for payment of its legal fees was denied as well by the federal court.
