Ripp Lawsuit Against City Dismissed

Planning Director Johnathan Smith told the Planning Commission that Baldwin Circuit Judge James Reid has dismissed the city as a defendant in a 2009  lawsuit filed by Parker Rd. resident and local political activist Paul Ripp, Tom and Lisa White, Chip Shaw and others. The plaintiffs had alleged drainage, landscaping and other deficiencies on the city's part during construction of the Publix grocery store shopping center on Greeno Rd.

Smith: " ... the city won ... I guess you could say ... at this point ... its good news ... ."

Mr. Ripp has frequently publicly complained about the city's high legal bills, urging the prompt settlement of lawsuits instead.

The lawsuit will continue against the property owners, developers, contractors and others.

(The plaintiffs still have the option of appealing the Judge's dismissal, according to Smith.)
