Fairhope, Alabama
By a 4-1 vote, the Board of Adjustments allowed Kevin Black's request to the use of a building at 212 Magnolia Ave as a tattoo salon business (also graphic arts). Since no specific mention is made of tattoo salons anywhere in the city's current zoning laws, the city's planning department asked the Board for clarification.
To assuage neighbors concerns, Black agreed to put no sign on the street and to close by 6PM, but he is not legally bound to do so.
The lone no vote was by Board Member Ray Clark, who feared "opening the door" to the proliferation of other such businesses throughout town. He also worried about another similar business someday locating there -- that may not be so neighborhood-friendly as Black's proposal.
Planning Director Johnathan Smith said he had been directed to draft a new ordinance to govern such applications in the future.
