New Lawsuit Concerning Church Parking

BAPTIST CHURCH PARKING CONTROVERSY RETURNS

Gaston St. resident William Hixson has filed a lawsuit against the Fairhope Board of Adjustments and Appeals for allowing several lots adjacent to the church to be used as parking lots. Hixson had filed a similar suit earlier in the year (click), but that one was dismissed for technical reasons.

The suit alleges the BOA "improperly allowed the church to use multiple residential R-2 lots as parking lots -- which is not a use under the zoning ordinance ...  causing adverse effects on property owned by the plaintiff."

During its regular meeting last August, the BOA had decided that parking was a permitted use under the city's zoning ordinance.

"Using residential lots for non-residential purposes takes away from the flavor of the neighborhood,” Hixson said. "We enjoy our neighborhood, and we like the eclectic nature of downtown Fairhope. My concern is that the neighborhood is going to be taken over.”

A monetary award is being requested and the trial is scheduled for May of 2013

It makes you wonder how many of the people parking there are within walking distance to the church? I am sure they could find better places to park, or maybe learn to carpool with others.

I think there are bigger issues out there to go after than a church and its parking. Some people have nothing better to do!

The church keeps the lot mowed and has added bushes which looks better than having a house that barely looks like it is standing. Or a yard that hasn't been mowed in a year. Plus people aren't parked there everyday of the week it is just for a couple hours on Sunday or when an activity is going on at the church. I think there are more important things in this world to worry about than this!

Someone living on Gaston is bothered by the Baptist Church vacant lot / parking areas? Is there one on Gaston? What about the old Fram's building on the corner of Gaston and Church? Surely he wants that old vacant building torn down--what's it doing for the neighborhood?

I believe he owns the old Fram store. Perhaps the Times could verify?

Well, well, one thing is for certain....lots of good baptists read the Times. The issue has nothing to do with emotion and shrubs and grass. It is the little quaint thing we used to call the law.

Yes he owns the old Fram's. Bought it and repainted like original to keep FBC from getting it and turning into a parking lot.

Oh yea, and the McMansion of his (that sits very close to the property line) didn't cause "adverse effects" on surrounding property or the great oak that had to be cut down as a result of that house being built.

The lot is rarely used...maybe a couple of times a week or on special events. What a total non-issue...this guy needs to get a life. "My concern is that the neighborhood is going to be taken over." Huh? By the dastardly Christians? By parking lots? Laughable...truly laughable. He should be embarrassed.

Christians are an easy target. Like someone said earlier, he wouldn't dare challenge this if it were a mosque!
