ZONING ISSUES RESOLVED?
The 'Little Point Clear' venue (click) on Scenic 98 south of town (1/4 mile north of the Grand Hotel, outside of city limits) has been cited by the county for zoning law violations (Planning District 26).
Adjacent property owner Ellen and Art Dyas and others had raised concerns about wooden decks/privacy fencing not being installed according to county zoning regulations (setback violations), blocked driveway access, inadequate number of parking spaces, and the facility being used in ways beyond what was permitted when the plan was approved in Oct. 2016 (more people attending than expected).
What was supposed to be an "office" being used as a "suite" instead was also mentioned by county staff.
A number of other citizens spoke in support however, citing no problems and how the building had been cleaned-up and made more attractive.
Confusion over enforcing regulations in overlapping planning jurisdictions (county and city) may have been a factor in the decking issues (referred to as a "boardwalk" in some places by the owner's attorney).
COMMISSION PASSED NEW RESOLUTION
After a lengthy hearing on August 3rd in Robertsdale, the Baldwin County Planning and Zoning Commission voted unanimously to allow it to continue operations as before contingent upon:
* A survey be provided verifying correct number of parking spaces and decks modified to conform to the Board of Adjustments' direction.
* Proof of off-site overflow parking be provided.
* Privacy fencing installed along the rear property line in accordance with architectural standards.
The Commission also amended the previously-approved scope of events that could be held there to include larger "meetings" -- such as wedding receptions.
Owner/operators Patricia Niemeyer and Rob Littleton were given up to thirty days to comply.
