TOO BIG?

House Bill 203, sponsored by Representative Joe Faust,  currently making its way through the state House of Representatives to put a constitutional amendment on the November ballot creating a Barnwell Landmark District was called absurd by councilman Burrell, because of its size: practically all of the unincorporated, un-zoned area south and southeast of the city.

The bill would put a local constitutional amendment on the ballot prohibiting any more annexations into the city from the area.

Synopsis of bill: "This bill would propose a local constitutional amendment relating to Baldwin County to define the Barnwell Landmark District within the county and to prohibit the annexation by local law of any property within the district into any municipality except under certain conditions."


Mayor Wilson said she had already met with state representatives about it ... and worried it could negatively impact the city's ability to control growth.

Wilson: "Creating a historic district for the Barnwell  Community is not a problem ... but this one makes up most of the unincorporated area to the south ... 44 square miles ... including parts of Pt. Clear, Clay City, Marlow, Fish River, Battles Wharf, Tatumville, Houstonville ..."

Councilman Burrell during yesterday's council meeting: "Its absurd ...  anything but just Barnwell. Intrudes upon the city's ability to expand ... govern."

Wilson told the Times later "bad information was being put out by proponents (click) who may not fully understand the law." She said she would have more to say about it soon.

Councilman Burrell contacted us later with additional comments about annexation: "They cannot be forcibly annexed.  Currently, they must request to be annexed."

(A smaller Stockton Landmark District was enacted by voters in 2012.)

Anyone outside city limits relies on the county for police protection and the city does not have a paid fire department, so...

Wrong dum dum! Fairhope police jurisdiction goes all the way to fish river including Barnwell. The city supplements the VFD with about $1 million a year for trucks, equipment and some salaries and fire call payments.

This is a case of overreach. You cannot be annexed unless you want to be annexed and someone wants to annex you. In other words both parties concerned need to agree it is a good thing. I am not crazy about historic districts but I can understand how some areas would prefer that. I cannot imagine an historic district even a square mile (around here). Is this the way this Faust guy uses his time ? I understand how the city , not for free, extends various coverages. I do think the recipients need to pay a premium price and I do not think they are paying enough. The leverage is entirely with the city and the city needs to act that way. Similarly I would like to see development, however small, pay the highest fees we can collect. I know AL law forces limits but I hope we are collecting the max.
It would be good if someone in development or the mayor would publically explain the numbers again.


I am generally in favor of annexation because we need more control of the developments immediately outside city limits.

To grow is to lose what we all love about Fairhope.The slogan grow or die,means the way of life is to end as many have come to enjoy. Small coastal towns will never die. As the federal goverment has written that there is a migration from north to south. And west -east to south, Why is that? Growth is coming but to control it ahead so that our services can catch up. Need the essential services in place before not after.

It is official !!
Most were relieved tonight at the Fairhope P&Z meeting where the motion to forward the Greeno Road Overlay to the Council failed to get a "second" and died on the vine thereby putting an end to that zoning madness .They will probably now sprinkle those elements into the upcoming Comprehensive Plan.

bruce you are wrong. the jurisdiction only extends from city property to either 1 and 1/2 miles or 3 miles, depends on what they are enforcing. from the southwest corner of quail creek gives them jurisdiction from part of 33, but not all of it. we gt ours from hoss and the sheriffs office. the same thing on the property southeast of the airport they use to claim there close to barnwell. most of us just do not want to be in fairhope. been there, done that, didint care for it and moved to the county

Be aware there is negative legislation brewing in the statehouse. You can read about the giant historic district. Also
The developers want to limit the city’s jurisdiction for any zoning outside city limits. I E they can do whatever they
please inch outside city limits. Finally there is an absurd ope records law proposed that will probably force a city like Fairhope to hire more employees to comply with the law. These add up to more wasted $ and a Wild West atmosphere outside city limits.
Things are bad enough without excelerating our problems. Montgomery could give a fig about Baldwin County.

As I read these posts it is obvious that many are fair new hear and really do realize that Baldwin co produces approximately 37% of state tax revenue.As for a historic district it should involve all areas south of cr 44 to mullet point and include Barn-well.That way the Tax revenue,of all inspections,and the Marriott grand Hotel and all other business revenue will go to the county.This will allow the county to establish one or two Sheriff offices and fire dept support.
The city has never really liked that area any way,yet they are the ones that shop in town.This will set a new growth,and possibly establish a new Point Clear municipality.This way they can have police ,fire,Grand hotel, new hotels and shops outside of fairhope and won't have to deal with the city inspections.Most of those in Point Clear surely can afford this change.Since the city seems to be buying all sorts of unnecessary properties.
Maybe even a new Arts and crafts festival could be established in a real historic district.

As for historical properties not there as land marks,time to read history of Mobile Bay.The Grand Hotel is a Historic Landmark,used as a hospital in the civil war,Operation Ivory Soap in WW2.and several other properties are historical significance to the area. SO to make the area a historic district is quite correct and plausible.As for funding,many of the properties are valued at or above 5-8 million per along the shore line.With one now at the highest priced residence in the state.So they can afford it.

South of county rd 32 has there own Fire Department. Also please do some research before you post Fairhope has an all volunteer department and Barnwell Fire department responses automatically with fairhope to may of there fires. The police jurisdiction does extend past the city limits and is payed for by the taxpayers outside the city limits that cannot vote in city elections. The city also provides services such as water gas and sewer outside the city limits that we are paying for the use of. we also have get not only county bulding permits but also city. If Fairhope wants to pull the police jurisdiction back they can take their taxes and bulding zoning back too.

That's exactly right.
Fairhope, keep your police and fire service. Barnwell has it's own fire department. Many of us country folks used to live in Fairhope and moved away to live a less restricted lifestyle. Give us a break!
No annexation for Barnwell!!!

We don't have city police or fire. Be informed. We do pay school taxes that we can use.
