OPPOSED BY NEIGHBORS

A rezoning request that was tabled from an earlier Baldwin County Commission meeting after encountering stiff resistance from neighbors was withdrawn by the property owner before a final vote was to be taken during the February 18 county commission meeting at the Fairhope courthouse.

Chason and Chason P.C. on behalf of property owner Robert Randall was asking to rezone 32 acres in planning district 37 at the northeast corner of the intersection of Hwy 104 and Saint Michaels Way from BCZ base community zoning, to RSF-2 single family housing -- and B-2, neighborhood business along the highway.

Numerous residents of the nearby Verandas neighborhood opposed on grounds of traffic, density, commercial incompatibility, and general quality of life issues. 

The commission voted unanimously to accept the withdrawal request; the property owner may submit a new application at some point in the future.

We as neighbors look forward to encouraging and assisting the developer to create a single family residential community that is compatible with existing development in our area and will add value to his investment and retain value in our investment.

The P&Z staff report is now out. It states that although the Randall property is being requested to be rezoned RSF-2, the P&Z Dept. still has the notion/idea that commercial/business and high density single family zoning is OK for this property. Why????? What are the reasons they are pushing this idea??? The residents in the area have clearly spoken against this suggestion. So P&Z Dept, speak up!

Possible reasons the P&Z Dept. is doubling down on their inappropriate land use idea, in spite of the fact all the neighbors are against it and the plan is incompatible with the surrounding land. 1) Fear of continuing or new lawsuits by the developer 2) Extracting increased tax revenue from the land if rezoned business/commercial use via property and sales taxes 3) Can't or won't admit their land use plan was misguided and wrong

Planning staff has to evaluate objectively by the book ... not subjectively based on feelings of neighbors.

The “book” is what has created inadequate roads and traffic control, crowded schools, crowded hospitals, taxed utilities. The neighbors voted these people in to write the “book”. Let’s vote them out and re-write the “book”.
I’m also wondering how the recent moratorium enacted by the Council plays a role in this….

There is no "book". They write the book, therefore everything they do is more or less subjective. The opinions of neighbors should be given MUCH more importance than it typically is. It's the neighbors who have to live with their subjective opinions.

Let’s add that many developments in the County have been annexed later by the City(such as Walmart). The City boundary map resembles Grandma’s quilt due to annexation.

Traffic has been bad since the Verandas were added. The complaints were spoken when they wanted to build the two subdivisions but since who it was they did it anyway. Sure they will bring to court and it will be changed.

Looks like TA25-01 is a Trojan Horse, paving the way for future business/commercial development of the Randall property. P&Z commission is using bait & switch deception in their documents. Time to DOGE the Baldwin County Planning & Zoning Commission?
