P and Z Discusses Subdivision, Sand Chimneys, Lawsuit

At its October meeting, the Planning and Zoning Commission: 1. Expressed mostly skepticism about a preliminary request from an Ingleside Ave. couple-- interested in subdividing their property (building another home in the rear). 2. Asked Head Planner Johnathan Smith to seek/provide more expert information about (sand) "chimney drains"--to determine if they should be permitted or banned by city regulations. Chairman Wilson: "(We) want the public to know . . . we're studying (these) issues . . . want to do the right thing." 3. Planner Nancy Milford provided an update on her efforts to better mesh city planning regulations with those of the county--to help simplify the building process for citizens in the planning jurisdiction outside the city limits. 4. Re-elected Jean Wilson as Chairman and Dick Charles as V.C. 5. Went into executive session to discuss a possible lawsuit-- concerning setback requirements (35ft)-- being threatened by the owner of the proposed Ansley Landing project on E. Gayfer Ave.(near Bishop Rd.).

Baldwin county is using sand drain chimneys under their new parking lots at the courthouse on Fairhope Ave. Don't hear anybody complaining about them.

ford owns property near both developments....west of the Gayfer/Bishop road proposal and east of the other. Ford's property and the property on the NW corner of Gayfer/Bishop is swampland. Ford stated a year ago, September, when another group came before P&Z he was ticked and was going to put up u store it facilities...also the county construction of the parking lot is using the chimneys, but that's county and Ford sold it to county, no appraisal for $400K which comes to about $15K per parking space, not considering the work to build the parking lot. Go to the judge of probate web site, look up names of property owners, you can find out who still owns what.

hope somehow p&z stick to their requirements re setbacks or on the other hand, could be quota for city law suits hasn't been met yet this year for city's attorneys. they do contribute heavily to campaigns and certainly expect a return for their dollars.
