Controversial Hwy 104 Rezoning Request Tabled

 TABLED UNTIL FEBRUARY

At the request of the applicant, the Baldwin County Commission voted to table a rezoning application for 148 acres along Hwy 104 until its February meeting.

A group of the neighborhood residents informing commissioners during the work session before the meeting they never received the required certified letter notifying them of the rezoning request was one reason cited for the delay.


From an earlier FT report:

"During its next meeting (Dec 16), the Baldwin County Commission will consider rezoning 148 acres just outside city limits on east Highway 104 from RA to RSF-2 (40K square foot minimum lot size to 15K sq. ft. min.). (Roughly across the highway from 3Circle Church.)

Bertolla Properties, Llc is the owner. Jade Consulting is their engineer.

This is the same property where a 'Colony Village PUD' was informally proposed to the Fairhope planning commission recently, for input in case it were ever to be formally proposed and annexed into the city.

The city's planing commission did not officially indicate how it felt about the project but some nearby county residents voiced opposition (Verandas neighborhood).

NO PLANS PRESENTED YET

This application to the county commission is only for rezoning; no specific plans are associated with it at this time.

Baldwin County planning staff says the rezoning is consistent with the county's master plan and zoning ordinance, but makes no recommendation one way or another in the associated documentation.

Our state representatives Elliot and Fidler better get ALDOT busy fixin' the clogged roads around here. There is an election next year you know!

Could not agree more on fixing the roads. Now apparently the bridges are rotten and need replacement as well. Let ‘s take some of the huge profits from all the development and put it into infrastructure- now there’s a concept.

There are going to be massive runoff volumes of rainwater from the development, including areas North and West of it, directly into Pensacola Branch, requiring large retention ponds to be built. If you figure in adequate USABLE greenspace in the development, there will be much less ground remaining for houses.

No more runoff after than before development is the engineering legal standard required.

According to what we learned with the runoffs south of town, the “legal standard” ain’t working.

Most retention ponds do not work very well. If you get two to three days of heavy rain the retention pond is full on the first day of rain, then rest just runs off. Major flooding will be more frequent especially along Fish River.

The retention ponds work exactly as designed, ie not adequate for all scenarios, and saves the developer lots of money because of that. The folks downstream pay the price.

Retention ponds have to be maintained by HOA's ... which is often not done at all ... so they do not work as designed.
